The SEC announced proposed crypto-custody rules on 1 October for registered investment advisers and regulated funds. The record concerns a proposed framework, so its permissions should not be reported as already available under a final rule.

The stated scope includes several custody arrangements

The announcement covers registered investment advisers, registered investment companies and business development companies. It describes proposed changes concerning financial-statement audits and broker-dealer custody services. The proposal would also allow state trust companies to act as custodians and permit self-custody in specified circumstances. SEC — Crypto-custody proposal announcement, release 2026-100

The SEC stated that comments would be accepted for 60 days after publication of the proposing release in the Federal Register. That trigger is distinct from the date of the press announcement; the latter alone does not establish the closing date. SEC — Crypto-custody proposal announcement, release 2026-100

A possible permission is not an operating exemption

WFN analysis: the announcement makes custody structure a concrete subject for review, but it does not replace the conditions in the proposing text. An adviser or technology provider should distinguish a future design option from authority to implement it now.

The same distinction applies to labels. Calling a service institutional, regulated or self-custodial does not explain who controls assets, which legal entity provides the service or how client holdings are recorded. Those questions need evidence from the actual arrangement.

For reporting, the defensible headline is about what the SEC proposed. Claims of automatic market access, assured demand or a completed regulatory solution would require additional records. This article makes no such claims and reports no measured price reaction.

Read the operative text and subsequent record

Identify the proposing release, Federal Register publication and provisions applicable to the relevant entity. Track comments, amendments and any later adoption separately from the original announcement.

If a provider invokes this proposal in marketing, ask which current requirement or adopted provision supports its claim. The October document supplies a dated regulatory development; it should remain visibly labelled as a proposal until a later record supports a different status.
